Why Yesterday’s Title 42 Injunction is Only a Temporary Victory
Sept. 17, 2021 — We at RAICES have a front row seat to the horrors of Title 42. Our clients are stuck in Mexico. Families fleeing violence are turned away. U.S. and international Asylum law is flouted.
That’s why we joined forces with The American Civil Liberties Union, Texas Civil Rights Project, Center for Gender & Refugee Studies, Oxfam, ACLU of Texas, and ACLU of the District of Columbia to fight back. Together we challenged the Title 42 expulsions in federal court.
We sought an immediate halt to the policy, and yesterday a federal court issued a preliminary injunction blocking Title 42 expulsions, granting the families we serve a temporary victory.
But this victory is indeed temporary. Tami Goodlette, Director of Litigation at RAICES says:
“Yesterday, a federal court blocked Title 42 expulsions of families seeking safety, issuing a preliminary injunction in Huisha-Huisha v. Mayorkas. This inhumane and unlawful policy has blocked thousands of migrant families from coming to the U.S. to apply for asylum. This victory is a major step to ensure that the U.S. welcomes families seeking asylum with dignity, but it’s only part of the battle. We still see thousands of adults being expelled under Title 42 every day.
And today, the Biden Administration already appealed the decision and is thus doubling down in its defense of this barbaric Trump policy. This is a disgrace. By defending Title 42, the Biden Administration has made it clear that it is willing to deny asylum seeking families their right to a full and fair process to receive protection in the United States. The Biden Administration has a moral obligation to stop using Title 42 to harm families and children and it must stop using Title 42 in its entirety. We urge the White House to rectify this rash decision to appeal and end the suffering for these families once and for all.”
RAICES will continue to fight and call for the end of this harmful policy.
